Event Terms and Conditions

These Event Terms and Conditions ("Event Terms") explain how Event Pricing, Fees, Taxes, and refunds work when you use the Services of Gatherings LLC dba Gaytherings ("Gaytherings," "we," "us," or "our"), whether you are purchasing tickets as an Attendee or hosting Events as an Organizer. By using our Services, you agree to these Event Terms, which form part of and are incorporated by reference into both our Terms of Service and our Organizer Agreement.

Organizers set the Event Price and the refund policy for their Events. Gaytherings provides the technology and infrastructure to list Events, process payments securely through our third-party Payment Processor, and apply the refund policy an Organizer has published for an Event. These Event Terms describe the applicable fees, how refunds work, and how we may charge or deduct amounts in connection with your use of the Services. Please read these Event Terms carefully and contact us at support@gaytherings.com if you have any questions.

1. Authorization

You agree to pay all amounts according to the terms presented to you at the time of purchase. By purchasing tickets to an Event on the Services, you authorize the charge of the full amount displayed at the time of purchase. Gaytherings acts as a technology platform facilitating transactions between Organizers and Attendees and is not responsible for disputes regarding the goods or services provided by an Organizer.

2. Event Prices and Total Price Display

The base price for Event tickets ("Event Price") is set by the Organizer.

Where we display a price for a ticket on the Services — including in search results, on Event listing pages, on Event pages, and at checkout — that displayed price is the total price you will pay, inclusive of the Event Price and any Fees passed on to you under Section 3, other than Taxes and any amounts you choose to add to your order. We will show you a breakdown of the Event Price, Fees, and Taxes before you complete your purchase.

Event Prices may change at any time prior to order confirmation at the Organizer's discretion. Availability is not guaranteed until your order is confirmed, and we do not guarantee that tickets will remain available at the price shown until you receive your order confirmation. Unless otherwise indicated, all prices for Events in the United States are stated in U.S. Dollars.

3. Fees

Two fees may apply to a ticket order placed through the Services (together, the "Fees"):

  • the Service Fee, charged by Gaytherings for use of the Services; and

  • the Payment Processing Fee, charged by our third-party Payment Processor to process the transaction.

Current rates for both are published on our website and in the organizer tools within the Services.

Who pays the Fees. For each Event, the Organizer selects how the Fees are allocated. The Organizer may absorb the Fees in full, pass them on to the Attendee in full, or share them equally between the Organizer and the Attendee. Where any part of the Fees is passed on to you, it is included in the total price displayed under Section 2 and itemized before you complete your purchase. Where the Organizer absorbs the Fees, they are deducted from the amount payable to the Organizer and do not increase the amount you pay.

In-person sales. Transaction fees for in-person sales made through our organizer tools, including Tap to Pay, are always charged to the Organizer and are never added to the amount an attendee pays. Those fees are described in the Organizer Agreement.

Refundability. The Payment Processing Fee is not returned to us by the Payment Processor when a transaction is refunded, and is therefore non-refundable in all cases, including where an Event is canceled. The Service Fee is non-refundable except as set out in Section 10 (Refunds) and Section 11 (Rescheduling and Cancellation) or where required by applicable law. Gaytherings may, in its discretion, refund or credit Service Fees in connection with disputes, technical errors, fraud prevention, customer support resolutions, or other circumstances determined by Gaytherings.

4. Payment Processor

All payments made through the Services are processed through a third-party payment processor ("Payment Processor"). We do not access or store financial information, including credit card numbers, bank account numbers, or any other information by which a charge can be made. By submitting payment information, you authorize the charge of the total amount due at the time of purchase.

By using our Payment Processor, you agree to its separate terms of service and privacy policy. We reserve the right to change the Payment Processor at any time. You understand and agree that we will not be held liable for your failure to complete a transaction through a Payment Processor on the Services. We are not responsible for resolving any dispute, support issue, penalty, or other matter that may arise between you and the Payment Processor or any Organizer.

5. Taxes

The purchase of Event tickets and other transactions through the Services may be subject to applicable federal, state, local, or foreign taxes, duties, levies, tariffs, or similar governmental assessments, including sales tax, use tax, value-added tax (VAT), goods and services tax (GST), amusement tax, entertainment tax, or similar indirect taxes (collectively, "Taxes").

Taxes are determined by reference to the location where the Event takes place, rather than your billing or residential address. Where Taxes apply and we are required or able to collect them, they are calculated at checkout and shown to you before you complete your purchase. In some cases, Taxes applicable to an Event are the responsibility of the Organizer and are already reflected in the Event Price.

You acknowledge and agree that Gaytherings and its Payment Processor may rely on third-party tools, services, Event location and venue information, Organizer-provided information, or other automated systems to determine applicable Taxes, tax jurisdictions, tax rates, or tax collection obligations. Gaytherings does not guarantee the accuracy of any tax determination, calculation, classification, or withholding.

You are solely responsible for any Taxes associated with your purchase that are not collected at the time of purchase but are otherwise required under applicable law.

Gaytherings and its Payment Processor reserve the right to collect, withhold, remit, report, adjust, or recover Taxes where required by applicable law or reasonably necessary to comply with tax obligations, governmental requests, or changes in applicable tax rules or interpretations.

6. In-Person and At-the-Door Sales

Some Organizers sell tickets, admissions, or other items in person at an Event, including through our Tap to Pay tools. Purchases made in person are subject to these Event Terms, except that:

  • the price charged is set by the Organizer at the point of sale;

  • transaction fees for in-person sales are charged to the Organizer, as described in Section 3; and

  • refunds for in-person purchases are determined and processed by the Organizer.

A receipt for an in-person purchase will be provided or sent to you where you supply contact details at the point of sale.

7. Order Confirmation and Processing

Your order is confirmed when you receive a confirmation number through the Services and/or a confirmation email at the email address you provided at the time of purchase. Your tickets are sent to that email address, whether or not you create an account.

You are responsible for verifying that your order has been successfully processed, including checking your email and, if you have an account, your account on the Services. If you experience technical issues or do not receive confirmation, contact us at support@gaytherings.com to determine whether your order has been placed. Gaytherings is not responsible for losses, including monetary losses, arising from your failure to verify or properly confirm your order, or for delays, failures, or errors in order confirmation caused by technical issues, payment processing errors, or incorrect information provided by you.

8. Organizer-Specific Terms

Certain Events may be subject to additional terms, conditions, requirements, restrictions, eligibility criteria, codes of conduct, cancellation policies, membership requirements, invitation requirements, age restrictions, or other rules established by the applicable Organizer ("Organizer-Specific Terms"). By registering for, applying to attend, purchasing tickets for, accessing, or participating in any Event, you agree to comply with the applicable Organizer-Specific Terms and any instructions, rules, or requirements communicated by the Organizer, venue operator, or applicable third party.

Organizer-Specific Terms are established solely by the applicable Organizer, and Gaytherings does not create, control, review, verify, endorse, or guarantee any Organizer-Specific Terms, except that we apply the Organizer's published refund policy as described in Section 10. Gaytherings is not responsible for enforcing other Organizer-Specific Terms or for resolving disputes relating to them, including disputes relating to eligibility, invitations, membership decisions, entry restrictions, conduct, or participation in any Event.

An Organizer may update Organizer-Specific Terms from time to time, provided that such modifications comply with applicable law. The refund policy applicable to an Event is fixed when the Event is published and cannot be changed by the Organizer afterwards. The refund policy that applied at the time of your purchase is the policy that governs your order.

If there is a conflict between these Event Terms and any applicable Organizer-Specific Terms, these Event Terms control solely with respect to your relationship with Gaytherings and your use of the Services, while the applicable Organizer-Specific Terms control with respect to the applicable Event and your relationship with the Organizer.

9. Event Participation and Liability Waivers

Certain Events may require you to review and agree to waivers, releases, assumptions of risk, codes of conduct, participation requirements, or other terms provided by the applicable Organizer ("Event Waivers") as a condition of registering for, accessing, purchasing tickets for, or attending an Event. Event Waivers are established by the applicable Organizer and may be modified, updated, or replaced by the Organizer at any time in its discretion.

By participating in an Event, you agree to comply with any applicable Event Waivers and acknowledge that failure to agree to or comply with an applicable Event Waiver may result in denial or revocation of access to the Event. All Event Waivers are provided solely by the applicable Organizer. Gaytherings does not prepare, review, verify, endorse, or guarantee any Event Waiver and is not a party to any Event Waiver between you and an Organizer. Your participation in any Event remains at your own risk.

10. Refunds

Each Event has a published refund policy. When creating an Event, the Organizer selects a refund policy, either from the standard options we make available or by providing its own custom policy. The applicable refund policy is displayed on the Event page and at checkout before you purchase, and is fixed once the Event is published.

We apply the published policy. Gaytherings applies the refund policy published for an Event to refund requests relating to that Event. Where a refund is due under the published policy, it will be processed through the Services. Where a request falls outside the published policy, the Organizer may still choose to approve it at its discretion, and Gaytherings is under no obligation to grant it.

Scope of a refund. Refunds may be issued in full or in part in accordance with the published refund policy and as supported by the Services. Except where required by applicable law, or as provided in Section 11, any portion of the Fees that was passed on to you is non-refundable.

Method of refund. All refunds are issued to the original payment method used for the purchase. Neither Gaytherings nor the Organizer is responsible for issuing refunds to an alternative payment method. If a refund is issued in error, Gaytherings reserves the right to recharge the original payment method for the amount of the erroneous refund.

You are responsible for reviewing the refund policy applicable to an Event before purchasing a ticket, registering for, or participating in that Event.

11. Event Rescheduling and Cancellation

Rescheduled Events. If an Organizer reschedules an Event, your ticket remains valid for the new date unless otherwise stated in the applicable Organizer-Specific Terms. Any refunds, credits, or exchanges for rescheduled Events are determined in accordance with the Event's published refund policy and applicable law.

Canceled Events. If an Event is canceled, orders for that Event are refunded automatically. You do not need to submit a request.

An automatic refund for a canceled Event covers the Event Price and any portion of the Service Fee that was passed on to you. The Payment Processing Fee is not refunded, because it is retained by the Payment Processor and is not returned to us when a transaction is reversed. The amount of any non-refunded Payment Processing Fee is shown to you in your refund confirmation.

Refunds for canceled Events are issued to the original payment method and may take a number of days to appear on your statement, depending on your bank or card issuer. Refunded amounts are recovered from the Organizer, including by deduction from amounts otherwise payable to the Organizer.

Cancellation by Gaytherings. Gaytherings reserves the right to cancel any ticket, order, registration, application, invitation, or transaction at any time and without notice, including if: (i) the price displayed for the ticket was incorrect; (ii) the ticket was made available for purchase before its scheduled sale date; (iii) the purchase exceeds stated ticket limits; (iv) an error, technical issue, operational issue, or security issue has occurred; (v) the transaction is suspected to be fraudulent, unauthorized, abusive, or in violation of these Event Terms, the applicable Organizer-Specific Terms, or applicable law; or (vi) Gaytherings determines that the transaction or Event may create risk or liability for Gaytherings, the Organizer, or other users.

Where Gaytherings cancels a ticket or order under this section, we will refund the amount you paid, including any Service Fee passed on to you, except where the transaction is determined to be fraudulent or unauthorized, or where a refund is prohibited by applicable law. The Payment Processing Fee is treated as described in Section 3.
