Tap to Pay Policy

This Tap to Pay Policy ("Policy") governs the use of the in-person payment features of the Services provided by Gatherings LLC dba Gaytherings ("Gaytherings," "we," "us," or "our"), including Tap to Pay functionality available through the Gaytherings Organizer app ("Tap to Pay"). This Policy forms part of and is incorporated by reference into our Terms of Service, Organizer Agreement, and Event Terms and Conditions. By enabling or using Tap to Pay, you agree to this Policy. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. What Tap to Pay Is

Tap to Pay allows Organizers and their authorized staff to accept in-person contactless payments at an Event using a supported smartphone — no card reader or additional hardware required. Attendees pay by tapping a contactless card or a mobile wallet (such as Apple Pay or Google Pay) on the staff member's phone. Tap to Pay can be used for door admission, tickets sold at the Event, bar and concessions, merchandise, coat check, and other items sold at your Event, including pre-defined sale items configured by role in your organizer dashboard.

2. Availability and Requirements

Tap to Pay is available to Organizers who have completed identity and payout verification with our Payment Processor and whose accounts are in good standing. Use of Tap to Pay requires:

  • the Gaytherings Organizer app installed on a supported iOS or Android device that meets the current operating system and hardware requirements shown in the app;

  • a device that is not jailbroken, rooted, or otherwise modified in a way that compromises its security, with a device passcode or biometric lock enabled; and

  • an active internet connection at the point of sale.

Payment types accepted may vary by device, card network, and region, and Tap to Pay functionality may be limited or unavailable in some countries depending on the capabilities of our Payment Processor and the applicable platform (Apple or Google) in that country.

3. Fees

In-person sales processed through Tap to Pay are charged a single rate of 2.9% + $0.30 per transaction, as published on our Service Fees page. This rate is always paid by the Organizer, is deducted before payout, and is never added to the amount the attendee pays. There is no subscription and no hardware cost. When setting prices for items sold at your Event, consider that this fee applies to each transaction.

4. Staff Access

Organizers may grant staff members access to Tap to Pay through the staff management tools in the organizer dashboard. Staff access is subject to the following:

  • staff are invited by the Organizer and receive a secure link to access the Organizer app for a specific Event;

  • the "Can accept payments" permission controls whether a staff member may use Tap to Pay;

  • staff access opens at the time selected by the Organizer when granting access — immediately, or a set number of hours before the Event's scheduled start time — and closes 30 minutes after the Event's scheduled end time, and the Organizer may revoke access at any time; and

  • the Organizer is responsible for the acts and omissions of its staff in connection with Tap to Pay, including sales made, refunds initiated, and the handling of attendee payment cards and devices.

Staff members may only use Tap to Pay on behalf of the Organizer for the applicable Event. Staff must never ask an attendee to hand over their card except as needed to complete a tap, must not photograph, record, or write down card details, and must not enter card numbers manually on behalf of an attendee.

5. Permitted and Prohibited Use

Tap to Pay may be used only to sell admission, goods, and services genuinely offered at your Event, in compliance with our Terms of Service, Event Guidelines, and applicable law. You must not use Tap to Pay to:

  • process transactions unrelated to your Event, or use Tap to Pay as a general-purpose payment terminal for another business;

  • sell anything prohibited by our Event Guidelines or by the rules of our Payment Processor or the card networks;

  • provide cash advances, cash back, currency exchange, or peer-to-peer money transfers;

  • process a payment using your own card or a card you control, including to test the system, simulate sales, or qualify for promotions;

  • split a single purchase into multiple transactions to avoid limits, or add undisclosed surcharges to the attendee's price; or

  • accept payment for a transaction you know or suspect to be fraudulent or unauthorized.

We may monitor Tap to Pay activity for fraud and compliance. We may suspend or revoke Tap to Pay access — for a staff member, an Event, or an Organizer account — at any time where we reasonably believe this Policy, the Organizer Agreement, or applicable rules have been violated, or where required by our Payment Processor.

6. Attendee Payments and Receipts

The amount charged for an in-person sale is set by the Organizer or its staff at the point of sale and is displayed to the attendee on the device before the attendee taps to pay. Attendees may be offered a receipt by email where they choose to provide contact details at the point of sale; contact details collected for a receipt may be used only to deliver that receipt and for related transactional purposes, and are handled in accordance with our Privacy Policy.

7. Refunds, Disputes, and Chargebacks

Refunds for in-person purchases are determined and processed by the Organizer, as described in our Event Terms and Conditions. Refunds are issued to the original payment method.

The Organizer is responsible for disputes and chargebacks arising from its in-person sales, including associated fees charged by the Payment Processor or card networks. Chargeback amounts and fees may be deducted from the Organizer's payouts. Clear item pricing at the point of sale, offering receipts, and honoring your published policies are the most effective ways to prevent disputes.

8. Taxes

Organizers are responsible for determining, collecting, reporting, and remitting any Taxes that apply to their in-person sales, including sales of goods such as merchandise, food, and beverages, in accordance with applicable law and our Event Terms and Conditions.

9. Payment Processing and Security

In-person payments are processed by our third-party Payment Processor. Card data is captured and encrypted by the supported payment functionality of the device and the Payment Processor's technology; Gaytherings does not access or store card numbers. Use of Tap to Pay on Apple devices is additionally subject to Apple's Tap to Pay on iPhone platform terms, and on Android devices to the applicable Google terms, each as presented in the Organizer app. You agree to comply with all payment security requirements communicated through the app, including keeping the Organizer app updated to the current version.

10. Service Availability

Tap to Pay depends on device capability, network connectivity, and the availability of our Payment Processor and other third parties. We do not guarantee that Tap to Pay will be available or uninterrupted at any given time, and we recommend that Organizers plan a fallback for accepting payment or admitting guests if connectivity at the venue is limited. Gaytherings is not liable for lost sales or losses arising from unavailability of Tap to Pay, to the maximum extent permitted by applicable law and as set out in our Terms of Service.

11. Changes to This Policy

We may update this Policy from time to time, including to reflect changes in our Payment Processor's requirements, supported devices, or applicable card network rules. Material changes will be communicated through the Services or by email. Continued use of Tap to Pay after changes take effect constitutes acceptance of the updated Policy.
