1. Acceptance of Terms

By accessing or using Gaytherings at gaytherings.com, you agree to these Terms. The Platform is operated by Gatherings LLC. If you do not agree, do not use the Platform.

2. Description of Service

Gaytherings is a free LGBTQ+ event discovery platform covering Los Angeles, San Francisco, and New York City. We are NOT a ticketing platform — all ticket transactions occur through third-party platforms or directly with event organizers.

3. User Accounts

• Event organizers may create free accounts to submit and manage events.
• You must provide accurate information and maintain account security.
• You must be at least 18 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Event Listings

Organizers are solely responsible for the accuracy of their event information. Gaytherings reserves the right to review, edit, approve, reject, or remove any listing. We may aggregate events from third-party sources. We do not independently verify all event information.

4a. Posting Events on Gaytherings

By submitting events to Gaytherings, you confirm that:

• You are the organizer of the event, or you have permission from the organizer to list it.
• You own all content you upload (text, images, flyers, logos), or you have the rights to use and share it on Gaytherings.
• Your content does not infringe anyone else's copyright, trademark, or other rights.
• You grant Gaytherings permission to display, share, and promote your event listing across our platform, social channels, and marketing.

You're responsible for the content you post. If a third party claims your content infringes their rights, you agree to cover any costs Gaytherings incurs as a result.

We may remove listings or accounts that violate these terms or receive repeated complaints.

5. LGBTQ+ Content Standards

All events must be relevant to the LGBTQ+ community and respectful of all identities. Events promoting conversion therapy, anti-LGBTQ+ ideology, or discrimination will be removed immediately.

6. Prohibited Content

• Fraudulent, misleading, or deceptive event listings.
• Harassment, bullying, or intimidation.
• Defamatory, illegal, or infringing content.
• Impersonation, spam, or unauthorized data collection.
• Attempts to compromise Platform security.

7. Intellectual Property

The Gaytherings name, logo, and design are owned by Gatherings LLC. Organizers retain ownership of their content but grant us a license to display and promote their events on the Platform.

7a. Data Protection and Prohibited Scraping

All event data, listings, descriptions, images, and curated content on Gaytherings are proprietary and protected by copyright and database rights. You may NOT:

• Use automated tools, bots, scrapers, crawlers, or scripts to access, collect, copy, or extract any data from the Platform or its APIs.
• Reproduce, mirror, republish, or redistribute event listings or data from Gaytherings on any other platform, website, application, or service.
• Use the Platform's data for training artificial intelligence, machine learning models, or any automated data processing without prior written consent.
• Access the API in any manner not expressly authorized in writing by Gaytherings.
• Circumvent rate limits, bot protections, access controls, or any technical measures we use to protect our content.

Gaytherings embeds digital watermarks and tracking mechanisms in its content. Unauthorized use of our data may be detected, and we reserve the right to pursue legal action including injunctive relief and damages. Violation of this section constitutes a material breach of these Terms and may result in permanent bans and legal proceedings under the Computer Fraud and Abuse Act (CFAA) and applicable intellectual property laws.

7b. Content & Copyright

Gaytherings is a community platform where event organizers post their own events. Organizers are responsible for the content of their listings.

If you believe content on Gaytherings infringes your copyright or other rights, please email info@gaytherings.com with:

• Your name and contact information.
• A link to the listing in question.
• A description of the content you believe is infringing.
• A statement that you own the rights or are authorized to act on the owner's behalf.

We review takedown requests promptly and will remove infringing content as appropriate.

8. Ticketing and Transactions

Gaytherings does not process payments, issue tickets, or handle refunds. All ticket purchases and disputes are between you and the event organizer or ticketing platform. We are not responsible for ticket availability, pricing, or fraud on third-party platforms.

9. Limitation of Liability

Gaytherings is provided "AS IS" without warranties. We are not liable for event cancellations, accuracy of third-party information, personal injury at events, ticketing issues, or any indirect damages. Our total liability shall not exceed $100 USD.

10. Safe Spaces Policy

We do not tolerate harassment, hate speech, or discrimination. We promptly investigate reports and remove violating content. Report concerns to info@gaytherings.com.

11. Termination

We may suspend or terminate your account at any time for violations. You may delete your account by contacting us.

12. Governing Law

These Terms are governed by California law. Disputes shall be resolved through binding arbitration in Los Angeles County.
